Website Terms of Use

The terms governing use of mealward.com and its public marketing surfaces.

Effective date: 21 May 2026 Last updated: 21 May 2026 Operator: Luke Ferguson, trading as Mealward (sole trader), ABN 17 977 307 913 ("Mealward", "we", "us", "our").

These Terms govern your use of mealward.com and its sub-pages (the "Website"). They do not govern use of the Mealward software-as-a-service product (the "Platform"); use of the Platform by paid customers is governed by a separate written agreement (the Master Services Agreement at /legal/msa) and Order Form.

By accessing the Website you agree to these Terms. If you do not agree, do not use the Website.


1. Permitted use

You may access and view the Website's pages and resources for lawful informational and procurement purposes, including:

  • Reading our trust, security, pricing, and product information;
  • Downloading or saving public-facing materials we have made available (e.g. handouts, this Policy, our Privacy Policy);
  • Contacting us about a potential commercial relationship; and
  • Reading documents under /legal/ for due-diligence purposes.

You may not:

  • Crawl, scrape, or automate access in a way that imposes an unreasonable load on the Website;
  • Attempt to access non-public areas of the Website (including any application or admin endpoints);
  • Reverse engineer, decompile, or attempt to extract source code from the Website;
  • Use the Website to send spam, phishing, or other unsolicited communications;
  • Misrepresent yourself or your affiliation with another organisation in any communication initiated through the Website; or
  • Use the Website in a way that violates Australian law.

2. Intellectual property

The Website's design, copy, code, logos, and product imagery are owned by Mealward or its licensors and are protected by Australian and international intellectual-property laws. You may quote short excerpts (e.g. for reporting, review, or procurement evaluation) with attribution to mealward.com. Bulk copying, mirroring, or redistribution requires our written permission.

The "Mealward" name and any associated logos are trade marks. Unauthorised commercial use is prohibited.


3. No advice; no warranty as to fitness

The Website provides general information about Mealward and the residential aged-care meal-management problem we solve. Nothing on the Website is:

  • Legal advice (including in respect of the Aged Care Act 2024 / NACA);
  • Clinical advice (including in respect of dietary or texture-modification requirements); or
  • Financial advice (including in respect of HEDL pricing structures or commercial outcomes).

You should obtain your own professional advice before relying on any information on the Website.

The Website is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all express or implied warranties about the Website (including warranties of accuracy, fitness for purpose, or non-infringement).


4. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any equivalent State or Territory legislation, where to do so would be unlawful.

If we are liable for breach of a consumer guarantee that cannot be excluded, our liability is limited (where permitted) to re-supplying the relevant content or service or paying the cost of re-supply.


5. Limitation of liability

Subject to Section 4, our total liability to you arising out of or in connection with the Website (whether under contract, tort, statute, or otherwise) is limited to AUD $100. We are not liable for any indirect, consequential, or incidental loss, including lost profit, lost business opportunity, or loss of data caused by your use of the Website.

This limit does not apply to liability for fraud, fraudulent misrepresentation, or any other liability that cannot be limited under Australian law.


6. Privacy

Our handling of Personal Information is described in our Privacy Policy. By using the Website, you acknowledge that the Privacy Policy applies.


The Website may contain links to third-party sites (e.g. our trust page links to documentation hosted by sub-processors, regulators, or industry bodies). We are not responsible for the content, security, or availability of those sites.


8. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the Website after we publish an update constitutes acceptance of the updated Terms.

If a change is material, we will give 30 days notice on the Website before it takes effect.


9. Governing law

These Terms are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria, Australia, and the courts of appeal from them.
